Welcome to the presentation website of Asociația Maxwell. Through this document, we make available to you the Regulation on the terms and conditions of use of this website.

This website is owned and operated by Asociația Maxwell, a Romanian nonprofit legal entity, registered in the Special Register of Associations of the Timișoara District Court under no. 11/18.02.2020, with tax identification number (CUI) 42809962 and its registered office in Timiș, Dumbrăvița, 145 Simfoniei Street, phone: 0723.612818, email: ong@johnmaxwell.ro. 

By visiting our website and accessing the information, resources, services, products and tools we offer you, you understand and agree to accept the Terms and Conditions set out in this document, as well as the terms and conditions set out in the Privacy Policy, with all the effects and consequences arising therefrom.

We reserve the right to change these Terms and Conditions of use without any prior notice. However, if these changes are likely to affect your personal rights and/or have implications for your personal data, you will be made aware of this through an automatic message displayed when you access the site, informing you of these changes.

Accordingly, you understand and accept that we have the right to decide to delete any content that we consider does not comply with these Terms and Conditions of use, as well as any content that we consider offensive, dangerous, unacceptable, inaccurate or that violates any copyright or trademark of a third party.
We are not responsible for any delay or failure to delete such content.
By continuing to browse this website, you consent and agree that we have the right to delete any content that violates the rules set out in these terms and conditions and, at the same time, you waive any claim against us.

h. We assume no liability for any content posted by you or by any third parties who use our website. 

i. You agree to indemnify and hold harmless Asociația Maxwell, its parent company and its affiliates, directors, officers, managers, employees, donors, agents and licensors from all damages, expenses, losses and costs, including attorneys' fees, resulting from any violation of these Terms and Conditions of Use or from any failure to fulfill obligations relating to your account, caused by you or by any other person using your account. We reserve the right to bring actions and defenses for any claim for which we are entitled to indemnification under these Terms and Conditions of Use. In such a case, you agree to cooperate with us to the extent reasonably required.

PRIVACY

Your privacy is very important to us, which is why we have created a separate Privacy Policy to explain in detail how we collect, manage, process, secure and store your personal information. LIMITATION OF WARRANTIES

LIMITATION OF LIABILITY

As stated above, you expressly understand and agree that any claim against us shall be strictly limited to the amount of money you paid for the use of the products and/or services, if any such amount was paid.

Asociația Maxwell shall not be liable for any direct or indirect, incidental or exemplary loss or damage that may arise from the use of our Resources or as a result of any changes to or loss of data, cancellation or loss of access, or any period of downtime, where these occur through no fault of our own.

COPYRIGHT/TRADEMARKS

All content and materials available on the website, including, but not limited to, text, graphics, the website name, code, images and logo, are the intellectual property of Asociația Maxwell and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site, is prohibited unless expressly authorized by Asociația Maxwell.

TERMINATION OF USE

You agree that, in the event of a breach of these Terms and Conditions of Use, the Privacy Policy or the law, we may suspend or limit your access to all or part of the website and our Resources. This may be done without prior notice.

Any activity suspected of being illegal, fraudulent or abusive may constitute grounds for terminating our relationship with you and may result in notification of the competent public authorities.

Furthermore, any action concerning the enforcement of these terms and conditions of use and the privacy policy falls under the jurisdiction of the courts of Romania at the registered office of Asociația Maxwell (Timiș, Dumbrăvița, str. Simfoniei, nr. 145).
